Microsoft has sent a powerful message to Washington about the limits of government authority over AI ethics by backing Anthropic’s landmark lawsuit against the Pentagon through a court brief filed in a San Francisco federal court. The brief called for a temporary restraining order against the supply-chain risk designation and argued that allowing the designation to stand would cause serious harm to national defense and commercial technology. Amazon, Google, Apple, and OpenAI have also sent Washington a message through their own joint supporting filing.
The message was sent in response to the Pentagon’s decision to label Anthropic a supply-chain risk after the company refused to allow its Claude AI to be used for mass surveillance of US citizens or autonomous lethal weapons during a $200 million contract negotiation. Defense Secretary Pete Hegseth formalized the designation, triggering the cancellation of Anthropic’s government contracts. Anthropic filed two simultaneous lawsuits in California and Washington DC.
Microsoft’s message to Washington is backed by its direct integration of Anthropic’s technology into military systems and its participation in the Pentagon’s $9 billion cloud computing contract. Additional federal agreements spanning defense, intelligence, and civilian agencies give Microsoft significant credibility. Microsoft publicly argued that the government and technology sector needed to cooperate to ensure advanced AI served national security without crossing ethical lines.
Anthropic’s court filings argued that the supply-chain risk designation was an unconstitutional act of retaliation for the company’s publicly stated AI safety positions, violating its First Amendment rights. The company disclosed that it does not currently believe Claude is safe or reliable enough for lethal autonomous operations. The Pentagon’s technology chief publicly ruled out renegotiation.
Congressional Democrats have separately demanded answers from the Pentagon about whether AI was used in a strike in Iran that reportedly killed over 175 civilians at a school. Their inquiries are reinforcing the message being sent to Washington from multiple directions. Together, Microsoft’s court filing, the industry coalition, and congressional pressure constitute a clear and powerful message to the Pentagon and Washington at large: AI ethics cannot be negotiated away.
